Ezekiel Elliott withdraws appeal, will serve all six games

The suspension stems from a domestic violence allegation by Elliott's former girlfriend in July of 2016.

The Cowboys running back announced on Wednesday that he will no longer appeal his suspension, which means that he'll definitely be out for the next five games.

Instead of hoping against hope that he could win his Dec. 1 hearing for a preliminary injunction and see him return before they play Dec. 10 against the New York Giants, the Cowboys know the next time they will see him at The Star will be Dec. 18 and the next time he can be on the field will be Dec. 24. However, the Second Circuit court did leave a small door open for Elliott to possibly continue his appeal.

Elliott served the first game of his ban this past Sunday against the Atlanta Falcons after the Second U.S. Circuit Court of Appeals denied his request for an emergency injunction at a hearing last Thursday in NY.

While authorities in OH chose not to press charges against Elliott, the National Football League conducted a 13-month investigation and on August 11 announced it had persuasive evidence Elliott committed domestic violence, which led to a six-game suspension.

"The decision arises from a practical assessment of the current legal landscape", read a statement from Elliott's attorneys sent to Rapoport. Elliott's arguments were rejected after the case moved to the NFL's preferred venue in NY, where two federal courts gave wide deference to Goodell's powers under the NFL's collective bargaining agreement, denying Elliott's request to continue playing as his lawsuit continued. In the meantime, he intends to release a "final personal statement" about Thompson's accusations and the suspension in the coming weeks. Prosecutors in OH didn't pursue the case.

The announcement was made Wednesday in a statement shared by Rocky Arceneaux and Frank Salzano, Elliott's agents. Goodell imposed the discipline after the National Football League conducted a year-long investigation into the allegations. Commissioner Roger Goodell's power remains intact.

The 22-year-old has rushed for 783 yards with seven touchdowns over eight games in his sophmore year in the NFL.

Dallas is 5-4 and now not in position to make the playoffs.
